Privacy policy — Trademark Almanac

Last updated: 14 September 2026

We do not collect anything.

Trademark Almanac has no account, no login, no analytics and no advertising. The marks you add, the dates and notes you record and the photographs you keep are stored on your devices and, if you use iCloud, in your own iCloud account. Upper Tail Software LLC never receives them, never sees them, and has no way to obtain them.

What is stored, and where

Everything you enter or add: the marks you track, the USPTO records the app fetched for them, the deadlines you marked done or silenced, your own dates and notes, and your photographs. All of it lives in the app's own storage on each device. If your device is signed into iCloud, the app keeps the copies on your devices in step through iCloud, in your own iCloud account, under Apple's terms. We have no access to your iCloud account. If you turn iCloud off, the app keeps working with what is on the device.

Looking up a mark

When you add a mark by its USPTO number, or the app refreshes a mark, it sends that number to a relay run by Upper Tail, which forwards the request to the United States Patent and Trademark Office using Upper Tail's own USPTO access key and returns the public record. The relay keeps no record of who asked and no log. It may keep the USPTO's answer for up to a day, in the Cloudflare data centre that served you, so the next request for the same public record is faster. The only things the relay sees are the number you looked up and your device's network address, and it keeps neither beyond the request. If you use your own USPTO key, record look-ups go to the USPTO directly; searching, the goods and services manual and the fee figures still go through the relay, since the USPTO offers no key for those.

The records themselves are public: they are the same records anyone can read on the USPTO's website.

Searching

When you search for a mark by words or an owner's name, or look up goods and services on a plan, the app sends the words you typed to the relay, which asks the USPTO's own search and returns what it found. The relay keeps the USPTO's public answer for up to an hour (marks) or six hours (goods and services) so the same search is faster next time; it files that answer under a digest of your words, not the words themselves, and the answer does not repeat them. Your words are not kept beyond the request, and no one at Upper Tail can see them. Every search is a search of public records; none is legal advice or a clearance.

Reminders, your calendar and your photographs

Reminders are scheduled on your device by the app and never leave it. If you choose to add a deadline to your calendar, the app writes the event into the calendar you pick, on your device, and asks for permission first. If you choose to add a photograph, the app reads it from your camera, your photo library or a file you pick, with your permission each time, and stores it with the mark; it reads the date inside the photograph, if there is one, and nothing else.

Subscriptions

If you subscribe, the purchase is handled by Apple through your Apple Account. The app asks Apple whether a subscription is active and records the answer on your devices. We never see your payment details.

Files you export

When you export a report, a calendar file or a photograph, the file is created on your device and you choose where it goes. Once you send it somewhere, it is governed by wherever you sent it. We are not involved.

Tracking

The app does not track you, does not use advertising identifiers, and contains no third-party software development kits.

Children

This is a business tool and is not directed at children.

Changes

If this policy changes, the new version will be published here and the date above will change.
